1. Introduction
This Acceptable Use Policy (“Policy”) defines the standards and expectations that apply to all clients who engage Buzz Clique LLC (“Buzz Clique,” “we,” “us,” or “our”) for digital agency services, including website design and development, WordPress maintenance, hosting, email, domain, advertising, SEO, content, AI-assisted services, and related services. By engaging our services, you agree to comply with this Policy in full.
This Policy should be read alongside our Privacy & Cookies Policy, our Terms, Conditions & Disclaimer, and our Refund & Cancellation Policy, all of which are incorporated by reference and form part of the overall agreement between you and Buzz Clique.
2. Our Approach to Client Service
Buzz Clique evaluates client work based on legality, platform requirements, service fit, operational risk, reputational risk, safety, and compliance with this Policy. We do not seek to police lawful viewpoints, but we reserve the right to decline, suspend, or discontinue services where the work presents legal, security, operational, platform, reputational, or service-fit concerns.
Our focus is on delivering quality service within legal, platform, and operational boundaries. The circumstances under which we may decline, suspend, or terminate service are those outlined in this Policy — specifically where a client’s content, materials, accounts, campaigns, or activities may be unlawful, harmful, abusive, prohibited by a third-party platform, or likely to expose Buzz Clique, its clients, or its service partners to legal, security, reputational, or operational risk.
3. Prohibited Content and Activities
Buzz Clique will not knowingly provide services in support of any website, account, campaign, or activity that is illegal, reasonably likely to be illegal, prohibited by applicable platform rules, or likely to expose Buzz Clique, its clients, or its service partners to legal, security, reputational, or operational risk. This includes but is not limited to clients or accounts that:
- Distribute, promote, or facilitate content that violates local, state, federal, or international law
- Engage in or facilitate fraud, deception, phishing, or other financially harmful activities
- Distribute malware, spyware, ransomware, or any other malicious software
- Facilitate the sale or distribution of illegal goods or controlled substances
- Host or distribute content that exploits or harms minors in any way
- Engage in unlawful harassment, threats, or stalking of any individual or group
- Infringe upon the intellectual property rights of others in a manner that violates applicable law
- Facilitate unauthorized access to computer systems, networks, or data
- Violate any applicable data protection or privacy laws
- Engage in any other activity that is unlawful or that exposes Buzz Clique or its clients to legal liability
Because laws, platform rules, and provider requirements vary, we evaluate potential violations based on the facts available, the services involved, the jurisdictions and platforms reasonably connected to the activity, and the risk presented to Buzz Clique, its clients, and its service partners.
4. Hosting Account Use
Hosting and related infrastructure services are sold by Buzz Clique through our reseller partnership with GoDaddy and are operated on GoDaddy’s underlying platform. Use of any hosting account purchased through Buzz Clique is subject to this Policy as well as GoDaddy’s Universal Terms of Service and any applicable product-specific agreements. Clients may not use hosting accounts to:
- Store, host, or distribute illegal content of any kind
- Host malware, phishing pages, or any other content designed to harm or deceive users
- Operate command-and-control infrastructure for malicious software or botnets
- Host content that infringes upon the intellectual property rights of others
- Engage in cryptocurrency mining, proxy services, or other activities that abuse server resources beyond the intended use of the hosting plan
- Conduct activities that compromise the security, stability, or performance of shared server infrastructure
Both Buzz Clique and GoDaddy reserve the right to enforce against violations of this Policy, GoDaddy’s terms, or applicable law independently of one another.
5. Email Account Use
Email services sold by Buzz Clique through our reseller partnership with GoDaddy are intended for legitimate business communication. Clients are responsible for ensuring their use of email services complies with all applicable laws, including but not limited to the U.S. CAN-SPAM Act, Canada’s Anti-Spam Legislation (CASL), the EU General Data Protection Regulation (GDPR) where applicable, and any other anti-spam or privacy laws that apply to their recipients. Clients may not use email services to:
- Send unsolicited commercial email (spam) in violation of applicable law
- Send phishing, fraudulent, or deceptive messages
- Spoof, forge, or misrepresent the sender identity, return address, or routing information of any message
- Distribute malware, ransomware, or malicious attachments
- Harass, threaten, or intimidate any recipient
- Send messages that violate the intellectual property rights of others
Where clients use email services for marketing or bulk communication, clients are responsible for ensuring that messages include accurate sender information, non-deceptive subject lines, any legally required advertising disclosures, a valid physical mailing address, and a clear unsubscribe or opt-out mechanism. Clients are also responsible for honoring unsubscribe and opt-out requests within the time required by applicable law.
Email deliverability, spam filtering, sending limits, and reputation management are governed by GoDaddy’s underlying platform and the receiving providers of recipient mailboxes. Buzz Clique does not warrant that messages will be delivered, accepted, or routed to inbox folders, and is not liable for deliverability outcomes.
6. Client-Provided Materials
For services that involve content, design, advertising, or other deliverables, clients are responsible for ensuring that any text, images, logos, video, audio, data, code, or other materials provided to Buzz Clique are:
- Lawful and not in violation of any applicable law or regulation
- Owned by the client or used with proper licensing or permission
- Not infringing on the intellectual property, privacy, or publicity rights of any third party
- Free of malicious code, embedded tracking, or other harmful components
Buzz Clique is not responsible for verifying the legality, ownership, or licensing status of materials provided by the client and is not liable for any claims arising out of the client’s use or distribution of those materials.
7. AI-Assisted Services
Buzz Clique may use, recommend, or fulfill services through artificial intelligence tools, including services delivered through our affiliated brand Momentium AI. Clients engaging AI-assisted services agree that:
- AI-generated outputs may contain inaccuracies, omissions, or unexpected results and should be reviewed by the client before publication or use
- The client is responsible for the final accuracy, legality, and appropriateness of any AI-generated content they choose to publish or distribute
- AI-assisted services may not be used to generate content that is illegal, defamatory, harassing, fraudulent, infringing, or otherwise prohibited under this Policy
- AI-assisted services may not be used to impersonate any person or entity in a deceptive manner, generate non-consensual intimate imagery, or produce content designed to deceive in ways that cause harm
Buzz Clique does not warrant the accuracy, originality, or fitness for any particular purpose of AI-generated outputs and is not liable for outcomes resulting from a client’s use of such outputs without independent review.
8. Advertising and Paid Media
Where Buzz Clique manages or supports paid media campaigns, including Google Ads, social advertising, and similar platforms, clients are responsible for ensuring that their products, offers, landing pages, and advertising materials comply with the policies of each advertising platform as well as applicable advertising, consumer protection, and disclosure laws. Buzz Clique is not responsible for account suspensions, ad disapprovals, or platform enforcement actions arising from client products, offers, or materials.
9. Plugin and Software Compatibility
Buzz Clique will make every reasonable effort to support the tools, plugins, and software installed on a client’s website. However, not all third-party tools are created equal and the quality, security, and long-term viability of plugins and software varies considerably.
Plugins or software that are abandoned by their developers, no longer receive active updates, are no longer compatible with current versions of WordPress, PHP, or database software, or that have been effectively sunsetted with no future development planned may reach a point where they can no longer be supported or maintained. In these situations, Buzz Clique will make every reasonable effort to notify the client of the issue and the potential impact it may have on their website’s stability and future.
Buzz Clique is not responsible for website failures, security vulnerabilities, or service disruptions that result from a website’s reliance on unsupported, outdated, or abandoned third-party software. We are not obligated to continue servicing a website that has reached a technical dead end due to its dependence on software that has no viable path forward.
10. Copyright Infringement and DMCA
Buzz Clique respects the intellectual property rights of others and expects its clients to do the same. If you believe that content hosted, displayed, or distributed in connection with services Buzz Clique has provided to a client infringes your copyright, you may submit a notice of infringement under the Digital Millennium Copyright Act (DMCA).
A valid DMCA notice should include:
- Your name, address, telephone number, and email address
- A description of the copyrighted work you claim has been infringed
- The specific URL or location of the allegedly infringing material
- A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law
- A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf
- Your physical or electronic signature
Copyright complaints may be sent to our copyright contact at dmca@buzzclique.com. Where content is hosted on GoDaddy infrastructure, copyright complaints may also be addressed directly to GoDaddy in accordance with their published procedures. If Buzz Clique later registers additional copyright contact information with the U.S. Copyright Office, this section may be updated to reflect that registration.
11. Violation Discovery and Service Termination
If Buzz Clique discovers or is made aware that a client’s content, account, or activities violate this Policy, we will assess the nature and severity of the violation to determine the appropriate course of action.
Standard Violations
For violations that do not pose an immediate legal risk or threat to others, it is our preference to provide the client with up to thirty (30) days advance notice before terminating service. This notice period is intended to give the client a reasonable opportunity to secure comparable services from another provider and ensure a smooth transition. Buzz Clique is not required to continue performing active work during this notice period if doing so would conflict with our obligations, platform requirements, risk standards, or this Policy.
Severe Violations
For violations that are severe in nature — including but not limited to content or activity that is actively harmful, exploitative, fraudulent, or poses an immediate legal risk — Buzz Clique reserves the right to suspend or terminate service immediately and without advance notice. The determination of severity is made at the reasonable discretion of Buzz Clique.
Third-Party Enforcement
Where the violation involves services provided through a third-party platform or reseller partner — including hosting, email, domain, or advertising services — those providers may also enforce against the violation under their own terms, independently of any action taken by Buzz Clique. Such enforcement may include suspension, termination, content removal, or account-level restrictions, and Buzz Clique is not responsible for the consequences of independent third-party enforcement.
Effect of Termination on Refunds
Service terminations resulting from a violation of this Policy are subject to the terms outlined in our Refund & Cancellation Policy. Termination due to a policy violation does not automatically entitle the client to a refund of any prepaid service fees.
12. Reporting a Concern
If you are aware of a website, account, or activity associated with Buzz Clique that you believe to be in violation of this Policy, please contact us in writing at support@buzzclique.com. Copyright-specific complaints should be directed to dmca@buzzclique.com. We take all concerns seriously and will review them accordingly.
13. Changes to This Policy
We reserve the right to update or modify this Acceptable Use Policy at any time. When changes are made, we will update the “Last Updated” date at the top of this page. To the extent permitted by applicable law and the terms of any separate written agreement, continued use of our services after changes are posted constitutes your acceptance of the updated Policy. We encourage you to review this Policy periodically.
